What you can do with this site, and what we stand behind.

Short version: read it, use it, run the open software under its licence. We organize evidence and run declared checks. We do not approve systems or sign for anyone.

About these terms

These terms are an agreement between you and Mekai Labs. They govern your use of the product site at kivy.mekailabs.com and the Live Lab at open.mekailabs.com. By using either, you accept them. If you do not accept them, stop using the site.

If you are using the site for an organisation, you confirm that you have authority to accept these terms on its behalf, and 'you' means that organisation.

This is version 1.0, dated 3 August 2026.

Definitions

Site
kivy.mekailabs.com, open.mekailabs.com, and the pages and files served from them.
Mekai Open
the freely available software we publish under an open-source licence.
Mekai Platform
the paid product, supplied only under a separate signed agreement.
Live Lab
the hosted page at open.mekailabs.com where you can run an analysis on a file you upload.
Content
the text, layout, images, structure and code we publish on the Site.

What you may do

  • Read the Site, share it, and quote it with attribution.
  • Download and run Mekai Open under the licence it is published with.
  • Upload a file to the Live Lab that you are entitled to share, and use the result it gives you.
  • Reference the Site in your own evaluation, procurement or engineering documentation.

What you may not do

  • Attempt to break, disable, overload or gain unauthorised access to any part of the Site or the systems behind it.
  • Scrape at a rate that degrades the service, or circumvent any rate limit or access control.
  • Upload anything unlawful, anything containing malicious code, or anything you are not permitted to share.
  • Use the Site to develop a competing product by copying our Content, as distinct from using Mekai Open under its licence.
  • Present the Site, its output, or our name as an approval, certification or endorsement issued by us.
  • Remove or obscure any notice of ownership, licence or provenance.

The Live Lab

The Live Lab is provided so you can see what the software does on data of your own. It processes what you upload for that session and returns a result.

You are responsible for having the right to upload what you upload. Do not put personal data, export-controlled material, or a third party's confidential information into it. We may limit, suspend or withdraw the Live Lab at any time.

What we own

The Content belongs to Mekai Labs or to our licensors, and is protected by copyright and related rights. You may quote it with attribution; you may not republish it wholesale or present it as your own.

The Mekai name, the Mekai Labs name and the logo are our marks. Do not use them in a way that suggests a partnership, endorsement, affiliation or approval that does not exist.

Mekai Open and open-source licences

Mekai Open is released under the GNU Affero General Public License version 3.0 only. Your rights in that software come from that licence, not from this page, and where the two differ the licence governs.

That licence has obligations as well as rights. In particular, if you modify Mekai Open and make it available to users over a network, you must offer those users the corresponding source of your modified version.

Third-party components bundled with or depended on by Mekai Open keep their own licences, which are listed in the repository. Nothing here grants you rights in those beyond what their licences give you.

Feedback

If you send us a suggestion, a bug report or an idea, you give us a perpetual, worldwide, royalty-free right to use it without obligation or attribution. Do not send us anything you consider confidential unless we have a written agreement covering it.

Contributions to the public repositories are governed by the contribution terms in those repositories, not by this page.

What Mekai does and does not decide

Mekai organizes evidence, runs declared checks, and reports what the available data does and does not support. A result marked PASS means the declared rule passed against the declared evidence. FAIL means the available evidence contradicts it. NOT VERIFIABLE means the evidence is missing, ambiguous, stale, conflicting or insufficient to judge.

Mekai does not approve systems, issue certification, perform conformity assessment, act as a notified body, issue safety findings, or replace the engineer, assessor or authority who signs. Engineering judgement, approval and accountability remain with you and the parties you appoint.

Nothing on this Site is legal, safety, regulatory or engineering advice, and nothing on it should be relied on as the sole basis for a decision about a real installation.

Availability and changes to the Site

We may change, suspend or withdraw any part of the Site at any time, including the Live Lab, and we do not promise that it will be available without interruption. We may need to take it down for maintenance or for security reasons with no notice.

We are not liable to you for making a change of this kind.

Disclaimer of warranties

The Site and the freely available software are provided as they are and as available, without warranty of any kind, whether express, implied or statutory. To the extent the law allows, we exclude the implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy and non-infringement.

We do not promise that the Site will be uninterrupted or error-free, that defects will be corrected, that it is free of harmful components, or that a result produced from your data will be complete or correct.

Descriptions on this Site of what the software does are descriptions of the product. They are not a commitment about a commercial outcome, an offer, or a term of any contract.

Limitation of liability

To the fullest extent the law allows, Mekai Labs is not liable for any indirect, incidental, special, punitive or consequential loss, or for lost profit, lost revenue, lost or corrupted data, business interruption, loss of goodwill, or delayed acceptance, sign-off or payment, however it arises from your use of the Site or of freely available software obtained through it.

Where liability cannot be excluded, our total aggregate liability arising out of or in connection with these terms is limited to one hundred United States dollars, or the amount you paid us for access to the Site in the twelve months before the claim, whichever is greater.

Nothing in these terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability the applicable law does not permit us to exclude.

The limits in this clause apply to the Site and to freely available software. Liability under a signed commercial agreement is governed by that agreement.

Indemnity

You will indemnify us against claims, losses and reasonable costs arising from your breach of these terms, from your unlawful use of the Site, or from material you upload that you had no right to upload. We will tell you promptly about any such claim and will not settle it without your agreement, which you will not withhold unreasonably.

Third-party services and links

The Site links to services we do not control, including GitHub and Cal.com. Their terms and privacy policies apply when you use them, and we are not responsible for what they do. A link is not an endorsement.

Commercial engagements

Any pilot, subscription, deployment or services work runs on a separate signed agreement covering scope, fees, service levels, data protection, confidentiality, intellectual property and liability. Where that agreement and these terms differ, that agreement governs.

Nothing on this Site creates a contract to supply Mekai Platform, and no statement here is incorporated into such a contract unless the signed agreement says so.

Export control and sanctions

You confirm that you are not located in, and are not acting for anyone located in, a country or entity subject to sanctions that would make your use of the Site or the software unlawful, and that you will comply with the export control laws that apply to you.

Suspension and termination

We may suspend or withdraw your access to the Site if you breach these terms or if we reasonably suspect misuse. You may stop using the Site at any time.

The clauses that by their nature should survive termination do survive it, including ownership, disclaimers, limitation of liability, indemnity and governing law. Rights already granted to you under the open-source licence are not affected by any suspension of Site access.

Changes to these terms

We may revise these terms. The version and date at the top tell you which one is current, and continuing to use the Site after a revision means you accept it.

If a revision materially reduces your rights, we will make that clear rather than relying on the date alone.

Governing law and disputes

These terms, and any dispute arising out of or in connection with them, are governed by the laws of India, without regard to conflict-of-law rules. The competent courts of India have exclusive jurisdiction, and you and we submit to that jurisdiction.

Before starting proceedings, write to [email protected] describing the dispute. We will try to resolve it with you within 30 days. This does not stop either of us seeking urgent injunctive relief.

If you are a consumer in a jurisdiction whose law gives you the right to bring proceedings locally, this clause does not remove that right.

General

  • Severability — if a clause is held unenforceable, the rest stays in force and the clause is read down to the minimum extent needed.
  • Waiver — not enforcing a term on one occasion does not waive it.
  • Assignment — you may not assign these terms without our written consent. We may assign them to a successor of our business.
  • Entire agreement — these terms are the whole agreement between us about the Site, and replace anything said earlier about it.
  • No partnership — nothing here creates a partnership, agency, employment or joint venture between us.
  • Notices — notices to us go to the email address on this page. Notices to you go to the address you last used to contact us.
  • Force majeure — neither of us is liable for a failure caused by something genuinely outside our reasonable control.
  • Language — the English version of these terms governs.
